Like I always said. All you need to do is threaten a seniority list and people completely lose all touch with reality. It's the most vulnerable part of the system and creates more infighting than anything else.
I don't know what exactly the issue is between encore and WS but it stands to reason, possibly ALPA constitution and possibly the law that you can't share or have a common seniority list between a unionized shop and a non-union shop, having said that, you can write whatever you want into a contract as long as it's legal. ALPA might not like it but you do what you want with your own property. Simple solution Encore joins ALPA as well. JAZZ pilots have been pushing a common, nation wide seniority list for years.

ALPA might have guidelines or suggestions as to how you deal with your CBA and seniority list, but ultimately those things belong to you. If WJ chose to include encore on their seniority list, there's nothing ALPA could do to stop them.
